These general terms of use (the "Terms of Use") define the rules for operation and use and the functionalities (the "Services") of the website
http://visiogo.bnpparibas (the "Site") offered by BNP Paribas through Epargne & Retraite Entreprises, which acts as broker, to the employee scheme members (the "Employees") of companies that have subscribed through BNP Paribas Epargne & Retraite Entreprises for an Employee Retirement Savings Scheme ("PER Entreprises") with insurance company Cardif Retraite (the "Companies").
Employees can use the Site, in accordance with the Terms of Use as defined below, to access general information on employee retirement savings and to check their account balance.
The Site also has a number of simulator applications.
Article II: Access to secure Services
Access to secure Services is via login ID and password (the "Login Details").
1) Allocation of Login Details
BNP Paribas Epargne & Retraite Entreprises sends Login Details to each Employee when they register with the Site.
2) Login Details
Login Details give access to the Site's secure Services. Employees will be sent their username by e-mail once they have signed up for the Site Services, registered their e-mail address and chosen a password. You are urged not to choose a password that can be easily guessed (such as your birthday, for instance).
3) Responsibilities of the Site user
The Login Details should be treated as personal and confidential. The user undertakes to keep his/her Login Details confidential and accepts liability for any consequences should they become known to others, whether by accident or design.
Your Login Details are confidential and must never be revealed either orally or by e-mail.
BNP Paribas will never ask you for your login ID or password by e-mail or telephone.
Users should be particularly on their guard for scam e-mails that may copy the look and name of BNP Paribas Epargne & Retraite Entreprise's website or mobile app to try and get you to reveal your Login Details (this type of fraud is known as "Phishing"). Users receiving such fraudulent e-mails should not click on any links nor reply to the e-mails and should never reveal their Login Details, even if an apparently official organisation asks them to.
Users therefore explicitly agree that any connection made using their login ID and password shall be deemed to come from the corresponding user, whatever the origin of the connection, unless BNP Paribas Epargne & Retraite Entreprises has been notified otherwise in accordance with Article IV below.
4) Get a new password
Employees can change their password on the Site by clicking on "I lost my password?". They can then reset the password by following a link sent by e-mail to their registered e-mail address.
The successful provision of Services requires a valid e-mail address to be provided.
This address is primarily used to confirm any changes to the Employee's account (change of e-mail address, password, etc). It can also be used to send information and notifications to Employees regarding the management of their contract.
When their account is created, Employees can choose whether or not to receive information and notifications by e-mail.
The e-mail address or mobile number may also be used to electronically sign an Employee's allocation adjustment and payment requests.
Lastly, the mobile number is used during voluntary year-end payment campaigns to notify Employees by text message when they only have a few days left to make a payment into their plan.
Pursuant to Article 22 of the Act of 21 June 2004 (Confidence in the Digital Economy Act), Employees may refuse to allow, or change their mind after agreeing to allow, BNP Paribas Epargne & Retraite Entreprises to use their e-mail address and mobile number. To do so, they simply need to go to the website, under "Menu" > "My Data" > "Contact Details", and change the parameters on the use of their e-mail address or write to the insurer at the following address: Cardif Retraite - Service Qualité Réclamations Clients - SH 944 - 8, rue du Port, 92728 Nanterre Cedex.
The Employee undertakes to immediately notify BNP Paribas - Epargne & Retraite Entreprises in the event of the loss or theft of their Login Details. Notification must be addressed directly to BNP Paribas - Epargne & Retraite Entreprises.
The contact details for notifying BNP Paribas - Epargne & Retraite Entreprises can be found under "Contacts" on the Site or notification can be sent by registered post to: BNP Paribas Epargne et Retraite Entreprises - TSA 80007 - 93736 Bobigny Cedex 09.
Telephone notifications must be immediately confirmed by registered post to BNP Paribas Epargne & Retraite at the above address.
In the event of any dispute about the notification date, both parties agree that it will be taken to be the date that BNP Paribas Epargne & Retraite Entreprises received the written confirmation only.
In the absence of notification, BNP Paribas Epargne & Retraite Entreprises may assume that any connection to the Site using the Login Details comes from the Employee to whom they were allocated.
The first time they sign in every Employee, having identified him/herself using their Login Details and changed their password, must read and accept these Terms of Use before they will be allowed to access the Site Services.
Any amendments to these Terms of Use shall be immediately notified to the Employees through the Site the next time they connect.
Any use of the Site Services counts as implicit acceptance of these Terms of Use.
BNP Paribas Epargne & Retraite Entreprises keeps an electronic record as proof that users have accepted the Terms of Use. If the Terms of Use are amended, only the proof of acceptance of the amended Terms of Use is kept.
Employees can read the Terms of Use at any time by going to the Site and clicking on "Terms of use".
Employees have three attempts to enter their Login Details. After the third unsuccessful attempt the internet connection is broken and any further attempt to sign in is blocked. In these circumstances, the Employee should immediately contact BNP Paribas Epargne & Retraite Entreprises for a reminder of his/her login ID and a new password by clicking on "I lost my password" on the Site or in writing to the postal address in Article IV.
Employees are granted indefinite access to the Services as from the date BNP Paribas Epargne & Retraite Entreprises sends them their Login Details.
Access to the Services will be terminated immediately if the Employee ceases to be a member of the PER Entreprises plan.
Employees can cancel access to the Services at any time by writing to BNP Paribas Epargne & Retraite Entreprises at the address in Article IV. Access will be withdrawn as from the day BNP Paribas Epargne & Retraite Entreprises receives the notification.
In the event of gross misconduct by the Employee, BNP Paribas Epargne & Retraite Entreprises can terminate access to the Services immediately.
1) General information
BNP Paribas Epargne & Retraite uses the Site to provide general information on company pensions, news, information about the policy and investment vehicles, financial simulators and detailed fact sheets on annuities or capital lump sums.
Employees can also find general messages on the Site.
2) Transactions
Employees can carry out the transactions listed below,

BNP Paribas Epargne & Retraite Entreprises undertakes to do all in its power within the limits of existing technology to ensure the proper functioning of the Services.
Services are accessible 24/7 except for occasional interruptions for essential technical maintenance and data base updates.
BNP Paribas Epargne & Retraite Entreprises cannot be held liable for data transfers or service interruptions following unforeseeable circumstances or acts of God, including in the event of:
The Site's double-click system allows the Employee to bring up a screen summarising their transaction with the first click and then either validate their choices, as summarised on a final screen, with a second click or go back and change them. The Employee explicitly accepts that this second click constitutes consent to the rights and obligations flowing from the transactions they carry out and is admissible in court as proof of consent.
Information collected via the website will be used by BNP Paribas to meet its legal and regulatory obligations in its capacity as the entity responsible for processing data for the purposes of Company Pension Plans.
This information may be transmitted to Cardif Retraite and to BNP Paribas service providers to perform services on its behalf for the purpose of managing the Employee's affiliation with a given policy, it being stipulated that said parties are bound by data security and confidentiality obligations, or to meet its legal and regulatory obligations.
For information on why their data is processed, their rights and the data conservation period, Employees may consult the Data Protection Notice on the website under "Data Protection".
It should be noted, however, that the personal data collected by the company are used until the end of the Employee's affiliation and as long as required to comply with BNP Paribas' legal obligations. Employees may exercise their right to access, rectify and contest the use of their personal data under the conditions and within the limits provided for by Act No. 78-17 of 6 January 1978, as amended (French Data Protection Act) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation), by writing to the following address: BNP Paribas Epargne & Retraite Entreprises - TSA 80007 - 93736 Bobigny Cedex 09.
The portion of your savings invested in units linked to your policy is not guaranteed and its value may rise or fall in light of stock market events. The insurance company is liable for the number of units only, but not for their value which reflects the value of the underlying assets. You therefore risk losing all or part of the savings invested in such units.
Any complaint relating to the accumulation phase of the supplementary pension must be sent to Cardif Retraite - Gestion Retraite Entreprises - 11-13, Cours Valmy - 92800 Puteaux.
Any complaint relating to the servicing phase of the supplementary pension should be addressed to Cardif Retraite - Customer Relations France - SH 944 - 8 rue du Port - 92728 Nanterre Cedex.
The Insurer undertakes to acknowledge receipt of any complaint within 10 working days of receiving it, unless it has provided a substantive response in the same period. Responses to complaints will be issued as soon as possible and, at the latest, within two months of receipt. If special circumstances should justify taking a longer period before responding, the contracting company or policyholder will be properly informed of this.
If you are unsatisfied with the response received, the contracting company or policyholder can write to Cardif Retraite - Quality and Complaints - SH 944 - 8 rue du Port - 92728 Nanterre Cedex.
The Insurer undertakes to acknowledge receipt of any complaint within 10 working days of receiving it, unless it has provided a substantive response in the same period. If you are unsatisfied with the response given and if you have exhausted all other internal channels of redress, the contracting company or policyholder can seek an opinion from the Insurance Ombudsman (Médiateur de l'assurance), who is independent of Cardif, without prejudice to the contracting company's rights to pursue a legal claim.
